Traffic School in Florida

Traffic school
isn't automatic.
It's an option
with limits.

Nobody gets a ticket and thinks, "Great, I'll spend four hours in traffic school." But when people hear that school can keep points off the record, it can sound like the easy answer. Sometimes it is a good option. Sometimes another option makes more sense. The important thing is to know which situation you are in before you elect it.

What to Know Before You Choose

  • Is the ticket eligible?
  • Are you eligible?
  • Do you have 30 days to elect it?
  • How many times have you used it before?

01 — The Most Common Mistake

Signing up for
the class is not
the same as
electing it.

You cannot just find a traffic school online, take the class, and assume the ticket is handled. First you have to qualify. Then you have to officially elect traffic school through the Clerk of Court. After that, you still have to find an approved school, complete the course by the deadline, and make sure the court receives the certificate of completion.

That election must be made within 30 days, in the county where the ticket was issued.

If that deadline passes, the normal traffic-school option may no longer be available.

In Miami-Dade, the election is made through the Clerk of Courts, and the course must be completed within the deadline the Clerk gives you.

If you elect traffic school and do not complete it by the deadline, points, additional costs, and a license suspension may follow.

02 — When This Can Be the Right Call

It's a card.
Use it when
it makes sense.

Traffic school isn't the best option for everyone or every situation. But there are times when it is the most practical choice. The question is whether this is one of those times for you.

When the Ticket Is Far From Home

You got a ticket in another Florida county, far from where you live. You looked at what it would cost to handle it another way and decided school made sense for this particular situation. That's a valid call to make.

When Your Record Isn't Clean

Your history isn't perfect. Last time you were in court, the judge made clear what would happen next time. You can't risk points now — your job, your license, or your situation won't allow it. If you are eligible and complete traffic school properly, points are not added for that ticket.

When You Want to Handle It Yourself

You may not want to fight the ticket, pay it and take the points, or hire a lawyer. If traffic school is available and you think it makes sense for your situation, it may be another option to consider.

03 — What Limits the Option

Not every ticket
and not everyone
qualifies.

Before assuming school is available, confirm these four things.

The Ticket Has to Qualify

Not every violation qualifies. For example, speeding 30 mph or more over the limit and certain license-related violations are excluded from the ordinary traffic-school election.

You Can't Have a CDL

Commercial license holders can't use the voluntary school election — even if the ticket happened in a personal vehicle.

Only Once Every 12 Months

You can't elect school if you already used it in the last 12 months. That period starts from the date of your last election, not the date of this ticket.

There's a Lifetime Limit

Florida limits this option to eight times in your lifetime.

04 — What to Understand

School isn't
a dismissal.

Traffic school can keep points off your record, but it does not make the ticket disappear. You still have to handle the ticket, complete the course, and use one of your limited school elections.

What's Still There

The ticket is still resolved with a withhold of adjudication, and no points are added. You still pay the civil penalty — although it is reduced by 18% when you elect school — and the traffic school itself also costs money.

What Else Is There

The school attendance also appears on your driving record. That does not mean points are added, but it is still another entry on the record.

A court resolution may sometimes result in a withhold without requiring a traffic-school election. Whether that is available depends on the ticket, the record, and the court.

Traffic school has its place. Sometimes it is the most practical choice. But it is still a choice, and it is worth understanding the other options before you use one of your limited elections.

05 — Before You Decide

Find out if you
qualify before
the 30 days
run out.

Before you elect traffic school, send me the ticket and let me look at the record first. I can explain the options, what each one may mean, and whether school makes sense before you use one of your limited elections.
